If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these terms.

You retain ownership of any content you upload or generate, including images, text, and other media.

By uploading or generating content through the Platform, you grant White Background a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, display, distribute, and process that content for the purpose of operating, improving, and promoting the Platform, including display within community or inspiration modules, subject to your selected plan.

Free users acknowledge that content generated using the free version of the service may be reviewed and published in community, gallery, or inspiration sections to showcase examples and demonstrate platform capabilities.

We may review, approve, reject, remove, decline to publish, edit, crop, or display content in a non-material manner for presentation purposes.

Paid users may be granted additional publishing controls depending on the features of the selected plan. Specific privacy and publishing options are described on the pricing page and may change over time.

Content generated by free users cannot be deleted by the user once it has been generated.

By continuing to use the free version of the Platform, you understand and agree that generated content may be retained on White Background servers, approved content may remain publicly accessible within the community, and requests for deletion of free-user content may not be supported.

Paid users may have access to additional content management or deletion features, subject to the limitations of their subscription plan.

We grant you a non-exclusive, non-transferable, revocable license to use the Platform, subject to these Terms of Service.

This license is for personal, non-commercial use only unless otherwise specified in your subscription plan. You may not sublicense, lease, rent, or distribute the Platform or any part of it.

You agree not to engage in any of the following activities:

Some features of the Platform may require payment or a subscription. If you subscribe to paid services, you agree to provide accurate billing information and authorize us to charge your chosen payment method.

We reserve the right to change subscription fees and pricing at any time. You will be notified of pricing changes in advance.

We may suspend or terminate your access to the Platform at our sole discretion, without notice, for any reason, including a belief that you have violated these Terms of Service.

Upon termination, your right to use the Platform will immediately cease, and content previously generated may remain retained or published in accordance with these Terms.

The Platform is provided "as is" and "as available." We do not guarantee that the Platform will be error-free, uninterrupted, or secure. We make no warranties regarding reliability, accuracy, or availability.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, even if we have been advised of the possibility of such damages.

Our total liability in connection with the Platform, whether in contract, tort, or otherwise, will not exceed the amount paid by you to use the Platform in the last 12 months.

You agree to indemnify and hold us, our affiliates, officers, employees, and agents harmless from any claims, losses, damages, or expenses, including legal fees, arising out of your use of the Platform, your content, or your violation of these Terms.

These Terms of Service will be governed by and construed in accordance with the laws of your country, without regard to conflict-of-law principles.

If a dispute arises between you and us regarding the Platform, we encourage you to contact us directly to resolve the matter first. If a resolution cannot be reached, you agree to submit the dispute to binding arbitration in your jurisdiction, conducted by a single arbitrator.

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect and use your personal data.
